Terms of Service

1. Acceptance

By using MOTURN you agree to these Terms. If you do not agree, do not use the service.

2. The service

MOTURN is a motorcycle community platform for planning rides, discovering places, and connecting with other riders. The service is provided "as is".

3. Age & Eligibility

You must be at least 16 years old to use MOTURN. By registering, you certify that:

• You are 16 or older in your country
• You have the legal capacity to enter into agreements
• You will not misrepresent your age or identity
• You are not prohibited from using MOTURN by applicable law

If you are under 16, do not register. If we discover you are under 16, your account will be terminated and all data deleted. False age representation violates these Terms and may result in permanent ban.

4. Your Account Responsibility

• You are responsible for keeping your password secure and confidential
• You are responsible for all activity on your account, including false age claims
• You may not create multiple accounts or impersonate others
• You must notify us immediately if you discover unauthorized access

5. User Content & License

By posting content (rides, reviews, photos, messages) on MOTURN you grant us a worldwide, non-exclusive, royalty-free licence to use, display, and distribute that content within the platform. You retain ownership. You must have the right to post any content you share.

6. Reviews and Ratings

Review Guidelines: By submitting reviews and ratings, you agree that:

• Your review is honest and based on genuine experience
• You will not post fake, fraudulent, or defamatory reviews
• You will not be compensated for your review
• You have the legal right to post your review
• You will not post photos without permission from others depicted

Review Moderation: MOTURN reserves the right to remove reviews that violate these standards, contain spam, harass other users, or contain illegal content. Moderation is performed as resources allow. If your review is removed, you may appeal by contacting hello@moturn.app with your reason for appeal.

Conflict of Interest: If you are associated with the place, event, or ride being reviewed (employee, owner, family), you must disclose this.

7. Prohibited Conduct

• Posting illegal, harmful, hateful, or offensive content
• Harassing, threatening, or defaming other users
• Scraping, crawling, or automated access without permission
• Posting fake or fraudulent reviews
• Impersonating other users or entities
• Using the platform to promote dangerous riding practices
• Violating others' intellectual property or privacy rights
• Circumventing account suspensions or bans

8. Paid Features & Billing (Future)

MOTURN is currently free. In the future, we may offer paid features for B2B event organizers through Apple App Store and Google Play Store. When subscriptions become available:

• Subscriptions will be managed through Apple and Google (we will not handle payments directly)
• Apple and Google terms will govern auto-renewal, cancellation, and refunds
• You will manage subscriptions through your Apple or Google account

9. Limitation of Liability & Disclaimer

Motorcycle riding is inherently dangerous. MOTURN is a platform that connects riders but is NOT responsible for:

• Accidents, injuries, deaths, or property damage arising from rides
• Misrepresentation of route difficulty or safety
• Conduct or negligence of other riders
• Condition of roads, weather, or external factors
• Third-party content, reviews, or user conduct
• Service interruptions, bugs, or data loss

You assume all risk when using MOTURN and organizing or joining rides. Always ride safely, within traffic laws, with proper gear, and at your own risk.

Indemnification: You agree to indemnify and hold harmless MOTURN, its owners, and operators from any claims, damages, or legal fees arising from your use of the platform, violation of these Terms, or your conduct.

Liability Cap: Our total liability for any claim arising from your use of MOTURN shall not exceed the amount you paid to MOTURN in the 12 months before the claim, or €100, whichever is greater. This does not limit our liability for death, personal injury, fraud, or violations of mandatory law.

10. Content Moderation & Enforcement

MOTURN reserves the right to remove content that violates these Terms, including:

• Illegal content or promotion of illegal activity
• Hate speech, harassment, threats, or defamation
• Spam or misleading advertising
• Fake or fraudulent reviews
• Explicit sexual content or child safety violations
• Copyright or trademark infringement

Process: Flagged content is reviewed within 24-48 hours. Repeated violations result in account suspension or permanent ban. We will attempt to notify you before removal, but in cases of serious violations (illegal content, harassment) we may remove without notice.

11. Account Suspension & Termination

User-Initiated Deletion: You may delete your account at any time via Settings → Account → Delete Account. Your account is deactivated immediately, and all personal data will be permanently removed within 30 days, except as required by law (10 years for transaction records for tax compliance).

MOTURN-Initiated Suspension: We may immediately suspend your account without notice for serious violations:

• Illegal content or activity
• Credible threats, harassment, or abuse of other users
• Payment fraud or chargeback disputes
• Repeated violations after warnings

Suspension Appeal Process: If your account is suspended, you may appeal within 30 days:

1. Email hello@moturn.app with subject "Account Suspension Appeal"
2. Include your username and detailed explanation of why the suspension was wrong
3. We will review your appeal and respond within 14 days
4. If reinstated, your account is restored within 24 hours

Account Termination: After the appeal period, we may permanently terminate your account. Termination is final. Banned users may not create new accounts. Your data will be deleted per Privacy Policy.

12. Dispute Resolution & Arbitration

Any dispute between you and MOTURN (including claims arising from these Terms or your use of the service) shall be resolved by binding arbitration rather than court proceedings.

• Jurisdiction: These Terms are governed by the laws of Italy
• Arbitration: Disputes are resolved by a single arbitrator in Italy
• Cost: Each party bears its own legal costs unless arbitration rules provide otherwise
• Exceptions: Small claims (under €500) may be filed in small claims court instead

13. Updates to Terms

We may update these Terms from time to time. When we make material changes (changes that significantly affect your rights or our obligations), we will:

• Notify you by email at your registered email address at least 30 days before the changes take effect
• Post the updated Terms on this page with an updated date
• Require your explicit acceptance (e.g., checkbox or button click) for material changes

Your continued use of MOTURN after material changes take effect constitutes your acceptance of the updated Terms. If you do not agree with any changes, you must stop using the service and may request account deletion.

14. Severability

If any provision of these Terms is found to be unenforceable, that provision shall be severed and the remaining provisions shall continue in full effect.
